Terms of Service

These terms are the agreement between you and TAS covering everything you do on this site: browsing, creating an account, placing an order, and buying ammunition or accessories.

Phase 1 note: this document is a structurally complete template. It has not yet been reviewed by counsel and must be before any real sale is made.

1. Acceptance of these terms

By using topammosupply.com, creating an account, or placing an order, you agree to these Terms of Service and to our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and Compliance & Restrictions page, each of which is incorporated here by reference. If you do not agree, do not use the site.

“TAS”, “we”, “us” and “our” mean Top Ammo Supply, trading as Top Ammo Supply. “You” means the individual using the site or placing an order. If you are ordering on behalf of a business or a club, you confirm you are authorised to bind that entity to these terms.

2. Eligibility and age

You must be at least 18 years old to browse this site, create an account, or place an order, and at least 21 to buy handgun ammunition.

Confirming your age to enter the site

On your first visit we ask you to confirm that you are 18 or older before you can use the site. Choosing “I am 18 or older” is a representation you make to us, and it forms part of this agreement. Choosing “I am under 18” ends your visit: access is blocked for the remainder of that browsing session and you may not use the site.

Confirming your age falsely is a breach of these terms. If we find that the confirmation was untrue, we may cancel any open or completed order, refuse future orders, and close your account, without liability to you and without prejudice to any other remedy we have.

The entry confirmation is a self-attestation, not identity verification. It does not check a document, it does not ask for your date of birth, and it does not tell us who you are. It records a flag in your own browser and nothing more. The Privacy Policy sets out exactly what is stored. Passing it is therefore not proof of age and does not entitle you to receive goods. We may require documentary proof of age, or use a third-party age or identity verification service, at any point before or after an order is placed and before anything ships. Every ammunition shipment requires an adult signature at delivery, and the carrier will ask for a valid government-issued photo ID.

A confirmation is stored in the browser you used and stops the prompt reappearing on that browser for 365 days. It is per-browser, not per-person: it records that someone using that browser confirmed, not who. Clearing your browsing data, browsing privately, or switching browser or device will bring the prompt back. That is expected and is not a fault.

Age limits by product type

The entry confirmation is not the only age control. Age limits by product type are applied again at checkout, tiered against what is actually in your cart:

• 18 or older: ammunition in a cartridge only a long gun chambers, and shooting accessories.
• 21 or older: handgun ammunition, and any cartridge commonly chambered in both a handgun and a long gun (10mm Auto, .17 HMR, .22 Short, .22 TCM, .22 WMR, .22 WRF, .223 Remington, .22 LR, .30 Carbine, .300 AAC Blackout, .350 Legend, .410 Bore, .44-40 Winchester, .450 Bushmaster, 5.56 NATO, 5.7x28mm and 7.62x39mm). We apply the stricter classification rather than the more permissive one.

These are the minimum ages federal law sets for licensed dealers, which TAS applies to every sale as a matter of policy, and higher state or municipal minimums where they apply. We hold to them on every order whether or not a given sale is one federal law binds in those terms, and we apply the stricter classification wherever a cartridge could go either way. Where your state or municipality sets a higher minimum age, the higher minimum applies. See Compliance & Restrictions for the detail.

Checkout requires a separate age and eligibility attestation on every order, and that attestation is part of the order record. The entry confirmation is not part of any order record and does not satisfy the checkout attestation.

3. Your representations

Each time you place an order you represent and warrant, on your own behalf, that:

• You meet the minimum age for every item in your order, the attestation you gave at checkout is true, and the age confirmation you gave to enter the site was true when you gave it.
• You are not a prohibited person under federal, state or local law (see section 10).
• You are buying for your own lawful use and not as a straw purchaser for someone else, and you will not resell or transfer the goods to anyone who could not lawfully buy them directly.
• The delivery address you gave is a real street address in a jurisdiction where you may lawfully receive the goods.
• The account, payment and identity information you gave us is accurate and belongs to you.

These representations are material. An order placed on the strength of a false representation is void, and we may cancel it, refuse future orders, close your account, and report the matter where the law requires us to.

4. Who you buy from

TAS is the seller and merchant of record for every order placed on this site. You buy from TAS. Your contract is with TAS and with no one else. We set the price, we take the payment, and we are responsible to you for the order, the returns and the refunds.

We do not sit on a single warehouse of our own. We buy stock from a network of supply partners who hold it in their own warehouses and ship it on our behalf, under our name, to the address you gave us. Those suppliers are not parties to your purchase and never collect payment from you. You do not enter a contract with them, and we do not act as your agent in dealing with them.

We decide which warehouse fills each line of your order, taking into account availability, whether the item can lawfully be delivered to your address, total landed cost, and dispatch cutoff. Where the same item sits in more than one supply partner’s warehouse, the alternatives are shown on the product page.

Because the stock behind your order sits in several supply partners’ warehouses, one order may reach you as several deliveries, on different days. You are charged shipping once, on the whole order. See section 7.

What we sell, and what we do not

TAS is a retailer of finished ammunition and shooting accessories. We resell ammunition manufactured by third parties, in unopened original packaging with readable lot markings, alongside accessories such as magazines, optics, storage, range gear, reloading equipment and cleaning supplies.

What we do not do is as much a part of the description:

• We do not sell firearms, of any kind, and we do not perform or coordinate FFL transfers.
• We do not manufacture, load, reload, remanufacture or import ammunition. We sell components and equipment for reloading; we do not assemble cartridges and we do not sell the output of anyone else’s press. The reasoning is in Product Safety & Handling.
• We do not buy ammunition back from customers to resell, which is the other half of why ammunition is not returnable.

We hold no federal firearms licence. 18 U.S.C. § 923(a) requires a licence to import or manufacture ammunition rather than to deal in it, and ATF’s published annotation to 27 C.F.R. § 478.41 states that a licence is not required for a dealer in ammunition only. The precise licensing position of an online ammunition retailer is the open item recorded in section 2 and sits with counsel; we state the citation here so that the absence of a licence number on this site is understood as deliberate rather than as an omission.

Where we are, and where we sell

TAS is a United States business, domiciled in the United States, and it sells within the United States only. Prices are quoted and charged in US dollars. We accept orders for delivery to United States addresses only, subject to the state and local restrictions on the Compliance & Restrictions page, and we do not ship internationally or to a US freight forwarder for onward export. Exporting ammunition is regulated under US export control law and is outside what this business does. Our registered address is in section 19.

5. Orders and acceptance

Your order is an offer to buy. Nothing on the site is an offer capable of acceptance by you, and no contract is formed when you click “Place order” or when you receive an automated order confirmation email. A contract is formed only when we dispatch the goods, and then only for the goods actually dispatched.

We may refuse, limit, suspend or cancel any order, in whole or in part, for any lawful reason. Reasons include, without limitation: the item is out of stock; we cannot lawfully deliver it to your address; the age or eligibility attestation looks incorrect; the order appears fraudulent or is flagged by our payment processor; the quantity is inconsistent with personal use; a price or description was wrong; or the order breaches a purchase limit.

If we cancel an order or part of one after taking payment, we refund the cancelled portion in full to the original payment method, with no restocking fee and no shipping charge for goods that never shipped.

6. Pricing and errors

Prices are in US dollars and exclude sales tax, which is calculated at checkout based on your delivery address. Prices, price-per-round figures, stock levels and delivery estimates can change without notice and are not held for items sitting in a cart.

Ammunition pricing moves quickly. Despite our efforts, a listing may occasionally carry a typographical, pricing, weight, specification or availability error. Where an error is obvious and material (a price clearly wrong by an order of magnitude, for example), we are not obliged to sell at the wrong price. We will either cancel the affected line and refund it in full, or contact you with the correct price so you can confirm or cancel. We correct errors as soon as we find them, at any point up to dispatch.

Promotional pricing, member pricing and free-shipping thresholds apply to the pre-tax subtotal after discounts, and cannot be combined unless the promotion says so.

7. Split shipments

Because we stock across several warehouses, an order containing more than one item may ship from more than one warehouse, in separate packages, on different days, with separate tracking numbers, and may arrive on different dates.

This is ordinary multi-warehouse logistics and it is not a partial failure of your order. You are charged shipping once, on the whole order, regardless of how many warehouses ship it. You will never be billed a second shipping charge because we sourced your order from more than one place. Full detail is in the Shipping Policy.

8. Shipping, risk and title

Delivery estimates are in business days and are estimates, not guarantees. Ammunition ships ground only, with an adult signature required at delivery. We do not ship ammunition by air, by USPS, to PO boxes, or to APO/FPO/DPO addresses.

Title and risk of loss pass to you on delivery by the carrier to the address on the order. If a shipment is lost or damaged in transit, tell us within 14 days of the last carrier scan and we will open a claim and make it right, subject to the Shipping Policy.

If delivery fails because nobody of legal age was present to sign, or because the address was wrong or incomplete, and the shipment is returned to the supplier, we refund the goods less the outbound and return shipping actually incurred.

9. Returns and cancellations

Ammunition cannot be returned once it has left our suppliers’ control. We cannot verify how a live round has been stored, transported or handled after it leaves a controlled warehouse, and we will not resell ammunition whose provenance we cannot vouch for. The only exceptions are a manufacturing defect or our shipping you the wrong item, both of which we fix at our cost.

Unopened, unused accessories in original packaging may be returned within 30 days. Full terms, including restocking fees, return shipping, and how returns work across a split order, are in the Returns & Refunds Policy.

You may cancel an order at no cost at any time before it is dispatched. Once a warehouse has dispatched a shipment, that shipment cannot be cancelled.

10. Prohibited buyers

You may not buy from TAS if you are prohibited from possessing ammunition under 18 U.S.C. § 922(g) or any equivalent state law. That includes, without limitation, any person who:

• has been convicted of a crime punishable by imprisonment for more than one year, or of a misdemeanour crime of domestic violence;
• is a fugitive from justice;
• is an unlawful user of, or addicted to, any controlled substance;
• has been adjudicated as mentally defective or committed to a mental institution;
• is subject to a court order restraining them from harassing, stalking or threatening an intimate partner or child;
• is unlawfully in the United States, or is in the United States on a non-immigrant visa without an applicable exception;
• has renounced United States citizenship, or was discharged from the Armed Forces under dishonourable conditions.

You also may not buy on behalf of any such person. Placing an order while prohibited is a federal offence, and completing the checkout attestation falsely does not transfer that liability to us.

11. State and local law

Ammunition is legal to buy and own across the United States, but it is regulated differently in every state and in some cities and counties. Restrictions cover permits, registration, magazine capacity, ammunition types, quantity limits, and whether ammunition may be shipped directly to a consumer at all.

It is your responsibility to know and obey the law where you live and where the goods are delivered. We screen orders against our restriction data and block what we can, but that data is a compliance aid, not legal advice, and it does not cover every local ordinance. If an item is unlawful for you to receive, do not order it. If we ship it because our data was incomplete, you must not accept or use it. Contact us and we will arrange its return at our cost.

12. Intellectual property

The site, its design system, page copy, product illustrations, data compilations, and the TAS name, cylinder mark and “Precision, Supply” tagline are owned by us or our licensors and are protected by copyright, trademark and other laws. You may use the site to shop and to manage your orders. You may not copy, scrape, republish, resell, or build a derivative catalog from any part of it without our written permission.

Manufacturer names, brand names, logos and product marks belong to their respective owners and are used to identify the goods we sell. Their use does not imply endorsement or affiliation.

If you post a review, a question or an image to the site, you keep ownership of it and grant us a non-exclusive, worldwide, royalty-free licence to display and use it in connection with the site. Do not post anything you do not have the right to post.

13. Disclaimer of warranties

The site is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, or that catalog data, stock levels, ballistic figures or restriction data are complete or current.

Goods sold through TAS carry the manufacturer’s warranty, if any, and we pass through the benefit of that warranty to you. We give no additional warranty on the goods themselves.

Ammunition and shooting accessories are inherently dangerous. Handloading, reloading, modifying ammunition, using ammunition in a firearm it is not rated for, or using a damaged or improperly maintained firearm can cause serious injury or death. You are solely responsible for the safe storage, handling and use of everything you buy from us, and for confirming that a cartridge is correct for your firearm before firing it.

14. Limitation of liability

To the fullest extent permitted by law, neither TAS nor its officers, employees, suppliers or carriers will be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of your use of the site or of any goods bought through it, whether the claim is in contract, tort, strict liability or otherwise, and even if we were advised such damages were possible.

Our total aggregate liability arising out of or relating to any order is limited to the amount you actually paid for that order.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for personal injury or for gross negligence or wilful misconduct. Where that is the case, the exclusions above apply only to the extent permitted, and nothing in these terms limits liability that cannot lawfully be limited.

15. Indemnification

You agree to indemnify, defend and hold harmless TAS, its affiliates, suppliers, and their respective officers and employees from any claim, demand, loss, liability, penalty or expense, including reasonable legal fees, arising out of: your breach of these terms; any false statement or attestation you made in connection with an order; your violation of any federal, state or local law relating to the purchase, possession, transport or use of ammunition; or your storage, handling, transfer or use of goods bought from us.

16. Governing law

These terms and any dispute arising out of them are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. TAS sells only within the United States and makes no representation that the site is appropriate or lawful anywhere else.

17. Disputes and arbitration

Please read this section carefully. It affects your rights.

Talk to us first. Most problems are an order problem, not a legal problem. Before starting a formal proceeding, send a written description of the dispute and the relief you want to legal@topammosupply.com. We will try in good faith to resolve it within 60 days.

Arbitration. If we cannot resolve it, any dispute arising out of or relating to these terms, the site, or any order will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before a single arbitrator, seated in Virginia or, at your election, in the county where you live, by telephone, videoconference, or on documents only. Judgment on the award may be entered in any court with jurisdiction.

Class action waiver. Disputes are resolved individually. You and we each waive the right to bring or participate in a class, collective, consolidated or representative proceeding. An arbitrator may not consolidate claims or preside over any form of representative action.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights or to stop unauthorised access to the site.

Opt out. You may opt out of arbitration and the class action waiver by emailing legal@topammosupply.com with your name, the email on your account, and a clear statement that you opt out, within 30 days of first accepting these terms. Opting out does not affect any other part of this agreement.

If the class action waiver is found unenforceable as to a particular claim, that claim is severed and heard in court; the rest of this section survives.

18. Changes to these terms

We may update these terms. The version in force for your order is the one published when you placed it, and we keep the last-updated date at the top of this page current. Where a change is material we will give notice on the site or by email before it takes effect. Continuing to use the site after a change takes effect means you accept the updated terms.

If any provision of these terms is held unenforceable, it is severed and the rest continues in force. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition or sale of assets.
