Illinois ammunition laws: FOID, delivery, and what actually gates a purchase
Illinois is the rare restrictive state that authorises ammunition delivery in the statute itself, then gates it: valid FOID or concealed carry licence before anything ships.

Illinois does what California and New York do not: it says yes to shipping ammunition to your door, in the statute, and then adds the conditions. 430 ILCS 65/3(b-5) permits a resident to buy ammunition from a person inside or outside Illinois by mail or private carrier, provided you hand over the right paperwork before the box moves. The gating is real, but the channel is open.
What the statute authorises
Section 3(b-5) has two conditions, and both must be satisfied before shipment rather than at delivery. The buyer must supply a copy of a valid Firearm Owner’s Identification Card or concealed carry licence, plus an Illinois driver’s licence or State ID. The ammunition “may be shipped only to an address on either of those 2 documents.” That last clause is why a parcel addressed to a workplace, a friend, or a rented storage unit fails: the delivery address has to appear on the FOID/CCL or the state ID.
The FOID itself is required to acquire or possess ammunition under 430 ILCS 65/2(a)(2) and 65/3(a), with a concealed carry licence as a full substitute. Illinois sets no separate ammunition age tier on top of that; instead, a FOID applicant under 21 needs active military or National Guard service, or written parental consent, under 65/4(a)(2)(i).

The state police verification path that does not exist
This is the correction worth the read. Illinois State Police pre-shipment verification is routinely described as part of the ammunition flow. It is not. Sections 3(a-10) and 3.1 of the Firearm Owners Identification Card Act impose their verification duties on firearms, stun guns and tasers — ammunition is not in the list.
The same is true of seller-side licensing. The Firearm Dealer License Certification Act, at 430 ILCS 68/5-10 and 68/5-15, reaches sellers of firearms and is built on holding a federal firearms licence and an in-state address. An ammunition-only out-of-state seller falls outside that structure entirely. The practical consequence for a buyer: the gate is your documents, supplied before shipment, not a state database query standing between you and the box.
Cook County, and the Chicago question
The one Illinois layer that bites remote buyers is the Cook County per round tax, and its history explains why summaries disagree. Guns Save Life v. Ali, 2021 IL 126014, decided 21 October 2021, struck sections 74-665 to 74-675 of the county code on the Illinois Constitution’s uniformity clause. That was a facial holding. The County Board amended the ordinance on 4 November 2021 to cure the defect by directing the proceeds, and collection resumed on 15 November 2021. A further amendment on 14 December 2023 added an express prohibition on acting as a retail dealer without registering.
So the tax was never really gone. The historic rates were five cents per centerfire cartridge and one cent per rimfire cartridge under section 74-668, but the current codified rate could not be verified because the county code host returned errors during research, as was the question of whether a remote seller with no Cook County nexus must register. What is on firmer ground is that the ordinance defines a retail dealer to include a person selling “to a person in the county”, which by its terms reaches out-of-state sellers. Verify the rate and the registration duty with the county before you rely on either.
Chicago sits inside Cook County, so the county tax applies there like anywhere else in the county. Our fact sheet does not resolve city-specific Chicago ordinances beyond that: if you are buying into the city, check the municipal code directly rather than assuming either that the state rule is the whole story or that a stricter city rule exists.
Order of operations for an Illinois buyer
- Hold a valid FOID or CCL before you order. The licence is the gate; there is no ammunition purchase without it under the Act.
- Send a copy of that credential plus your Illinois driver’s licence or State ID to the seller before shipment, exactly as 65/3(b-5) requires.
- Ship to an address printed on one of those two documents. This is the condition buyers fail most often, and it is checked at the seller’s end.
- Check the county you are having it delivered into for a per round tax before you assume the posted price is the delivered price. Carrier mechanics themselves are covered in how ammunition ships.
None of this stops you stocking practice ammunition: a case of .223 for the rifle and 9mm at the current $0.27 a round ship to an Illinois address the same way they ship anywhere else, provided the paperwork arrived first.
