Massachusetts ammunition laws: the unsettled delivery question

Massachusetts is blocked in practice and unsettled in law. The licensee rule that closes the mail-order channel, the licence structure behind it, and the exposure nobody has resolved.

Massachusetts is the hardest state in this series to describe honestly, because the honest description is two things at once. In practice, the mail-order channel is closed: retailers decline Massachusetts orders as a matter of policy. In law, whether the statute that produces that result actually reaches an out-of-state shipper has never been settled. Blocked in practice, unsettled in law.

What the statutes say

The provision everyone points to is M.G.L. c. 140, s. 123(k), which bars a licensee from filling a mail, telephone or internet order without “the in-person presentation of the required license… prior to any sale, delivery or any form of transfer.” Read against a licensed Massachusetts ammunition seller, that sentence kills remote fulfilment outright: the buyer must be physically present with their licence before anything moves.

The credential structure sits alongside it. An FID covers non large capacity, non semi automatic long guns “and the ammunition therefor”; an LTC covers firearms including large capacity “and the ammunition therefor” — M.G.L. c. 140, s. 129B and s. 131. Ages follow the credential: FID at 18, with 15 to 17 possible on a parental permission certificate, and LTC at 21, under s. 129B, s. 131 and s. 128A. Selling ammunition inside the commonwealth without a licence is penalised by s. 122B(e), which reaches whoever “not being licensed… sells ammunition within the commonwealth”.

The phrase “and the ammunition therefor” is the hinge. Your credential does not merely authorise you to possess a firearm; it carries the ammunition for that class of firearm with it, and it carries the age attached to it. An LTC holder is 21 because the LTC is 21, not because Massachusetts writes a separate ammunition age somewhere else. The credential governs the cartridge, and the credential’s age governs the buyer.

Two renumbering corrections

Anyone reading older Massachusetts analysis will hit two traps. M.G.L. c. 140, s. 131E was repealed by St. 2024, c. 135, s. 59 — any source citing s. 131E for ammunition purchases is out of date. And s. 122B is no longer the ammunition seller licence; the seller licence is s. 122. Both corrections come from the statutory text rather than from commentary, and both change which section you should be reading.

The unsettled question: does any of it reach you?

Here is where the fact sheet refuses to guess. Whether s. 122 or s. 122B(e) reaches an out-of-state shipper is marked unverified. The penalty in s. 122B(e) is written territorially, s. 122 assumes fixed in-state premises, and no Massachusetts case resolving the point was located. This is unquantified exposure rather than a settled prohibition.

The consequence for a shopper is that Massachusetts behaves like a closed state without a statute that says “closed”. National retailers decline the address, local counters handle the volume, and the resident never sees the underlying question resolved. Whether that is required behaviour by sellers or merely cautious behaviour is precisely what no located case has decided.

How a Massachusetts resident should approach an order

  1. Work out which credential you hold. An LTC covers everything and needs you to be 21; an FID covers the narrower long gun category from 18. The ammunition you can buy follows the credential you produce.
  2. Plan a face-to-face transaction with a Massachusetts licensee — s. 123(k) requires in-person presentation of the licence prior to any sale or delivery, and that applies whether you buy across a counter or over the phone.
  3. Do not build a plan around shipping. Until counsel resolves the extraterritorial question, an out-of-state order into Massachusetts is a bet against an unread statute. The general rule for what can move and how is in how ammunition ships.
  4. Check the current text of s. 122 and s. 123 against the official General Laws before you rely on this or any summary, including ours. The same advice applies to the island state with a different problem altogether: a statute that asks for an age and an ID, and nothing more.

What you cannot do is buy your way around the structure: there is no Massachusetts credential that converts a mail order into a compliant one. Practice ammunition is still worth planning for — a case of .38 Special or 9mm, at the current $0.27 a round on the 9mm floor, is the same economics as anywhere else; only the collection point differs.
